I need some help.

Is it possible to rule out 2nd winter Herring Gull from the existing photos? These are unfortunately the only photos I have.

i think, yes, it is possible to rule out 3cy HG.
3rd gen. type scaps and median coverts are just too dark, primaries look
jet black and structure is betetr for a fuscus ssp.

Agree that it´s not a Herring. All dark inner primaries exludes that.
Also take a look at this thread, with special notice to Jörgen Bernsmo´s gull, which also can be seen here with a few comments:
