Mystery gull in Madrid

In this links you can find a 2º winter bird photographed in november 2008 and other bird photographed in November 2009 in Madrid. I think that can be the same bid, but I can not identify.

I remember this gull from back in Nov. 2008, which was discussed in several forums at the time - here:

Looks like the same gull in 2009.

So what do others think?

Well, I think the discussion has ended into consensus about the ID for most people (if they didn't fall asleep).

Found some pictures in my mailbox, made by Delfin...
Cropped it a bit and resized it to 800px. Delfin will send more probably...

One picture is from 2008, one from 2009.
